Plaintiff Jill Witte claims that AT&T used the promise of gift cards, often worth $100 to $400 and expiring after 150 days, to entice new customers to sign up.

“Instead of sending cards to new customers as soon as they sign a contract and pay for their new AT&T service, AT&T does not send gift cards or delay delivery so that new customer recipients do not receive cards near or after 150. days to expiration,” the class action lawsuit says.

Also, Witte accused AT&T of trying to offer customers lower-value cards than previously promised.

Witte says the offer of a $150 gift card from AT&T convinced him to sign a deal with the company last year to get a bundle of TV and Internet services.

Although he was told the gift card would arrive in the mail within six to eight weeks, Witte says it never did in that time, and an AT&T representative ultimately told him he wasn’t eligible to receive it.

Witte says AT&T eventually agreed to send her a $50 gift card, which she says she eventually received.

Once activated, AT&T restricts the use of gift cards, such as disabling the card for an extended period of time if a threshold amount is spent.

“AT&T’s processes, restrictions and limitations on gift cards and the adverse effects of reducing the actual cash value of gift cards to new customers were not adequately disclosed at the time new customers were induced to sign their contracts. for services bundled with AT&T,” the class action lawsuit says.

Witte claims that AT&T is guilty of negligent misrepresentation and unjust enrichment and of violating Florida’s Unfair and Deceptive Trade Practices Act.

Witt intends to represent AT&T National Class and Florida Subclass clients.

Plaintiff requests a jury trial and seeks declaratory and injunctive relief, along with punitive, special, treble and general damages for herself and all class members.

A similar class action lawsuit was filed against AT&T last year by a consumer in Florida who argued the company never mailed or issued expired gift cards to new customers who switched providers.
