Suboxone is a drug used to treat opioid addiction, according to Drugs.com. The drug comes in the form of tablets and films.

According to the FTC, Reckitt Benckiser and Indivior colluded to maximize Suboxone profits at the expense of consumers. In an effort to convince more patients to take their brand-name drug, the company allegedly misled patients and doctors by claiming that the film version of Suboxone was safer than the tablet version.

In order to profit from this alleged false advertising, Reckitt Benckiser and Indivior suppressed generic competition by filing “baseless” petitions with the US Food and Drug Administration (FDA), the FTC asserted. The petition reportedly reiterates unsupported safety claims about the film version of Suboxone and urges the FDA to reject the application for a generic pill substitute.

The FTC says this action causes consumers to pay more for Suboxone, when, in a healthy market, they would be able to buy a cheaper generic version of the drug.

Indivior Agrees To Pay $385m Amid Monopoly Lawsuit

In July 2020, Reckitt Benckiser agreed to a $50 million settlement to resolve these claims. Shortly thereafter, Indivior agreed to pay $10 million to settle the allegations.

In May 2021, the Federal Trade Commission distributed more than $59 million to users who were prescribed Suboxone. Of this, $42 million was sent in the form of 37,212 checks, while the remaining $16 million was sent in the form of 14,663 prepaid debit cards. 51,875 paid an average of $1,139.

With the remaining $500,000 from the settlement fund, the FTC distributed payments to consumers who submitted valid claim forms.

Suboxone Lawsuit Claim

These payments are only available to consumers who contact a claims administrator after the original 2021 claim deadline and request to be placed on a waiting list for payment. Consumers cannot file a claim if they have not added their name to the waiting list by September 2021, even if they are eligible for payment.

There is no deadline for exceptions or objections listed on the settlement website. The FTC’s Suboxone settlement is not subject to final court approval.

Indivior has agreed to settle a $30 million antitrust class action lawsuit to resolve allegations that it colluded with other companies to raise the cost of Suboxone, a treatment for opioid addiction.

The antitrust class action lawsuit accuses Indivior of colluding with other companies to raise the price of Suboxone and its generic alternatives. According to the plaintiffs in the case, they were forced to pay more for Suboxone as a result of the antitrust scheme.

Indivior To Pay $385 Mln To End Final Suboxone Monopoly Lawsuits

Indivior did not admit any wrongdoing but agreed to a $30 million settlement to resolve the antitrust class action claim.

Under the terms of the Suboxone Class Action Settlement, Class Members may receive a prorated portion of the Net Settlement Fund based on the amount they spend on eligible purchases. The exact payment will vary depending on the number of claims submitted and other factors.

A final approval hearing for the Suboxone antitrust class action settlement is scheduled for October 19, 2023.
